U. S. Supreme Court to Hear Texas Case on Homosexuality



Court decision could open floodgates for gay adoptions

The U.S. Supreme Court has accepted a case that sets the stage for

reconsidering its approach to homosexual rights that will impact 13 states

and their view of allowing homosexuals to adopt children. In 1986 the high court upheld a Georgia law that outlawed sodomy. In 1998 the Georgia Supreme Court overturned that case and the state no longer has a law prohibiting consensual

sex between adults of any gender. In 1986, twenty-five states had laws outlawing sodomy. Today only 13 do. The Texas case (Lawrence vs. Texas) which outlaws

sex between the same sexes is also in effect in Kansas, Oklahoma and Missouri.



Sodomy is a crime with either sex in the states of Alabama, Florida, Idaho, Louisiana, Mississippi, North Carolina, South Carolina, Utah and Virginia.

If the case in Texas were overturned, it would impact the laws of these states.

In child custody and adoption cases, when the issue of whether a homosexual should be allowed to adopt or have custody of a child, these laws stand as a

barrier to them being able to do so.



Due to the willingness of the Supreme Court to re-visit the issue, it is a possible indication that the justices are considering revising the laws or overturning the

case completely. In the 1986 court decision, Bower vs. Hardwick, Supreme Court Justice Lewis F. Powell, Jr., voted in a 5-to-4 decision to uphold the Georgia

law prohibiting homosexual conduct. He later said publicly that he regretted his

vote. Three members of the court, Chief Justice William H. Rehnquist and

Justices Antonin Scalia and Clarence Thomas, are likely to vote to uphold the

Texas law. The other six justices are possibly open to changing the law and extending the rights of homosexuals. These six justices were the majority vote

in another key case involving the rights of states to prevent cities and towns from adopting gay rights ordinances. That 1996 case (Romer vs. Evans) overturned a Colorado law that was passed by the citizens of Colorado banning cities and towns from passing pro-gay rights ordinances.



The Texas case is another key potential landmark case that could impact the

nation just as the infamous Murray Case outlawing school prayer in 1963 began in Texas and the infamous Roe v. Wade case legalizing abortion in 1973 began in Texas.



Prayer Strategy: Pray that the eyes of those justices that are leaning to

overturning this key Texas case will be open to see the impact on children in adoption and child custody cases. Pray that the attorney’s representing the

State of Texas will have wisdom and the Mind of Christ in arguing for their case

to be upheld. Pray that the U. S. Supreme Court will uphold Lawrence v. Texas.

Pray that the attorney’s for Texas will be prepared. Pray for them during

preparation over the next three months and the presentation in April before

the nation's high court.



Prayer Timeline: The case will be argued in April and decided by early summer.
